Privacy Policy
What we collect, why we collect it, and exactly who your details go to. In plain English, then in full.
Version 0.1 (draft), not yet in effect. A date is set when it goes live.
The short version. When you use our match form, your details go to one licensed installer we match you with, so they can contact you and quote your job. Installers pay us a per-lead referral fee for that introduction. We do not sell your details to marketers or data brokers, and we don't add you to marketing lists without your separate say-so.
1. Who we are
The Aircon Guys ("we", "us", "our") is a lead-referral service that matches Victorian homeowners with a licensed installer for aircon and heat-pump work. The entity that collects your information is The Aircon Guys (ABN 68 413 660 175), a sole trader based in Victoria. We are the entity responsible for the personal information collected through this website.
We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Because we pass leads to installers for a fee, we treat ourselves as bound by the Privacy Act in full, and we don't rely on the small-business exemption.
2. What we collect
We only collect what we need to match you and let an installer quote your job:
- Contact details you give us: your name, phone number and email address.
- Job details: your suburb or postcode, the type of work you're after, and anything you choose to tell us about your home or current heating.
- Your consent record: the fact that you agreed to have your details passed to one matched installer, plus the version of the wording and the date and time you agreed.
- Basic technical information: we use privacy-friendly, cookieless analytics, so we measure visits without tracking you across the web or building an advertising profile of you.
We collect this directly from you when you fill in a form. We don't buy your details from anyone else.
3. Why we collect it
- To match you with one licensed installer who covers your suburb and can quote your job.
- To let that installer, and us where needed, contact you about your enquiry.
- To keep an honest record that you consented, in case there's ever a question about it.
- To run, secure and improve the service.
4. Who we share it with
This is the part that matters most, so we're specific:
- One matched installer. Your details go to a single licensed installer we match to your job, so they can contact you and quote. Not several, and not a call centre. Installers pay us a per-lead referral fee for that introduction. That's how the service is free for you.
- Service providers that run our systems, such as our website host and our email-delivery provider, only so the service works, and only under obligations to keep your data confidential and use it solely on our behalf.
- Where the law requires it, for example a valid request from a court or regulator.
We do not sell or rent your details to marketers, advertisers or data brokers. We are paid by installers for the introduction, not by trading your information around.
5. Overseas storage
The providers we use to host the site and send our emails (such as Cloudflare and Resend) may store or process some data on servers outside Australia, including in the United States. Where that happens, we take reasonable steps to make sure your information is handled consistently with the APPs. If we change providers, we will update this section.
6. Consent and marketing
When you submit the match form, you're consenting to one thing: your details going to one matched installer for this enquiry. That consent is separate from any marketing, and it isn't bundled with anything else.
We won't add you to a marketing list or send you promotional messages unless you separately opt in, and any message we do send will comply with the Spam Act 2003 (Cth) and give you a way to unsubscribe. You can withdraw your consent at any time by contacting us, though we may not be able to unwind an introduction an installer has already acted on.
7. How long we keep it
We keep your details only as long as we need them for your enquiry and to meet our legal and record-keeping obligations. After that we anonymise or delete them, so old enquiries stop being personally identifiable rather than sitting in a database forever. You can ask us to delete your details sooner (see your rights below).
8. Security
We take reasonable steps to protect your information from loss, misuse and unauthorised access, including limiting who can see it and using reputable, secured providers. No system is perfectly secure, but if a data breach ever occurred that was likely to cause you serious harm, we would act on it and notify you and the OAIC as required under the Notifiable Data Breaches scheme.
9. Your rights
Under the Australian Privacy Principles you can:
- Ask what we hold about you and get a copy of it.
- Ask us to correct anything that's wrong or out of date.
- Ask us to delete your details, subject to any records we're legally required to keep.
Just contact us (below) and we'll action it. There's normally no charge, and we'll respond within a reasonable time.
10. Complaints
If you think we've mishandled your information, contact us first and we'll try to sort it out. If you're not happy with how we handle your complaint, you can take it to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
11. Changes to this policy
We may update this policy as the service grows or the law changes. The current version and its date will always be on this page.
